ARCHIVED - Murcia region approves fines structure for non-compliance with covid measures
Not wearing a mask; breaching quarantine order; organising an illegal gathering which attracts a large crowd of people are all subject to fines under the new decree
On Thursday morning the Murcian regional Government approved a decree during a regional cabinet meeting (Consejo de Gobierno) which establishes a series of sanctions relating to non-compliance with the measures established to prevent the spread of Covid-19.
The decreto-ley lays down the fines which will be imposed and range from 100 to 600,000 euros, depending on the gravity of the infraction committed regardless of whether it has been committed in a private gathering or public place.
The purpose of the Decree Law approved today is to adopt measures that allow the Administration to deal quickly and effectively with the resolution of the sanctioning procedures that are initiated for non-compliance with the current restrictions. This resolution classifies the faults as minor, serious and very serious, depending on the conduct and the exposure to the health risk that it entails.

The new Decree gives the regional government a clear structure on which to base the fines and the power to enforce them.

Minor infractions are sanctioned with fines ranging from 100 euros up to a maximum of 3,000. The non-use or incorrect use of a facemask is considered a minor fine valued at 100 euros; failure to display information advising clients that they must use masks and observe social distancing on the part of shops or bars is also considered a minor offence; non-compliance with hygiene and general measures, when it does not pose a risk of contagion or affects less than 15 people falls into the category of minor offence; non-compliance with the precautionary measure of self-isolation agreed with the health authority for people who have not tested positive for covid- 19, but are direct contacts of a confirmed patient also falls within the boundaries of a minor offence.
Serious offenses include non-compliance with hygiene and prevention measures established for any type of establishment or activity, in spaces or premises, public or private; not respecting the limits of capacity or the maximum number of people allowed to be in establishments or participate in activities; non-compliance with the preparation of contingency plans and organization of gatherings, fiestas or parties in which there are crowds that make it difficult to adopt preventive sanitary measures (ie those organising gatherings which attract large groups of people); or non-compliance with home isolation or confinement for those who have tested covid-positive. These cases of serious infringement will be sanctioned with a fine ranging between 3,001 euros and 60,000 as the maximum amount.
Finally, fines of up to 600,000 euros, are for very serious offences, which may pose a risk of contagion to more than 100 people such as events which have been organised to earn money, and include undertaking activities that have been expressly suspended or forbidden and repeated breaches of home isolation ordered by the health authority.
It also gave the regional Ministry of Health the power to close establishments believed to be a health risk and reduce the capacity of others, as well as pass other measures helping to limit the spread of the virus within the region.
It gives the regional minister very widesweeping powers as the text says: "“empower the head of the Ministry responsible for health for the adoption, in exceptional cases and due to urgency, of additional temporary measures to guarantee the health of citizens, suspending, modulating or even modifying the measures contained in the Agreement itself, in order to give a quick and effective response to any problem or public health emergency that could be derived from the evolution of the epidemiological situation. Likewise, it could adopt any other measures of a temporary and restrictive applicable to certain sectors or defined territorial areas, in those cases in which the appearance of localized outbreaks of the disease would make it advisable to adopt more stringent measures to guarantee collective security.”
Yesterday the regional government called for the national Government to standardise the fines and fine structure nationally and create this legislation at national level to ensure an equal application of the law nationally.
