ARCHIVED - Spanish government passes law establishing basis for remote working or working from home
The BOE published the text on Wednesday and the law will come into force in 20 days
“Distance work” or working from home will be considered as “regular work” and, therefore, will be regulated by this new law, providing it accounts for at least 30% of the working day.
On Tuesday the Council of Ministers gave the go-ahead to new telework regulation after reaching an agreement with social agents following several months of negotiation.
The Official State Gazette (BOE) published the new law on Wednesday and the legislation will come into effect within 20 days.
“Distance work”, “teletrabajo” or working from home will be considered in the same light as “regular” employment and, therefore, will be regulated by this new law, providing it accounts for at least 30% of the working day or the equivalent proportional percentage based on the duration of the employment contract, in a three month period of reference.
Remote work must therefore be paid for or compensated by the company and the company must provide the equipment, tools and means linked to the undertaking of the work activity. Obviously there are cases in which the employee will already possess the necessary equipment, but prior agreement must be reached to ensure that employees are adequately compensated for the costs of working from home and their expenses covered.
Collective bargaining agreements or agreements may establish the mechanism to determine and pay the corresponding expense compensation.
According to the norm, as long as employees are obliged to work from home as a result of the health containment measures derived from the pandemic, ordinary labour regulations will continue to apply.
Voluntary and irreversible
In general terms, distance work will be voluntary and reversible and will require the signing of a written agreement, which may form part of the initial contract or be carried out at a later time, without this modality being imposed.
The law distinguishes between distance work (work activity from the home or place chosen by the worker, on a regular basis); telework (distance work carried out exclusively or predominantly by computer or telematic means and systems), and face-to-face work (which is provided in the workplace or in the place chosen by the company).
In work contracts entered into with minors and in internship and training and learning contracts, a distance work agreement can only be reached that guarantees at least a 50% percentage of the provision of services in person, without prejudice of the telematic development of the theoretical training linked to the latter.
Equal rights
Employees who work remotely will have the same rights as those in person and may not suffer damage to their working conditions, including remuneration, job stability, working time, training and professional promotion.
The refusal of an employee to work remotely, the exercise of reversibility to face-to-face work and the difficulties for the proper development of the telework activity exclusively related to the change from a face-to-face service to another that includes telework, will not be deemed justifying causes for dismissal or for the substantial modification of working conditions.
People who work remotely from the beginning of the employment relationship for the entirety of their working day will have priority to fill jobs that are carried out totally or partially in person, so the company must report available vacancies.
They will have the right to training in terms equivalent to face-to-face workers; to professional promotion; to digital disconnection; the right to privacy and data protection; to safety and health at work, and to receive from the company the appropriate means to carry out its activity.
This new law will be applicable to existing labor relations that were regulated, prior to their publication, by collective agreements or agreements from the moment they lose their validity.
In the event that said agreements and conventions do not establish a term of duration, the rule will be fully applicable once a year has elapsed since its publication in the BOE, unless the parties agree to a longer term, a maximum of three years.
