And it looks as though the 'red tape' issue will further delay the opening of the commercial centre after months of frustrating delays held up the first phase which began in July and is still underway. This involves the demolition of the 10,000m2 basement of the old building and three other abandoned premises.
It appears Cartagena Council has refused to issue the developer, Certain S.L., with a 'certificate of unnecessariness' to set up the complex, a document required for the processing of licences for major works on plots of land or properties affected by urban planning.
Any subdivision, segregation or division of land is subject to a municipal licence, so the local authority must declare it 'unnecessary' for the project to continue and for the developer to be able to move forward. This has meant Certain S.L, has not yet been able to finalise the arrival of new businesses to the future shopping centre.
At the end of July, when the first phase of the shopping centre finally began, the deputy mayor and town planning councillor, Ana Belén Castejón, told the developers they would be granted the certificate "within a week".
This didn't happen, and José García of Certain S.L.said the firm was instead given "a document in which they denied this permission".
"The document was requested in October last year, and, according to the law, the council had three months to reply. In the end it took 11 months. Now they say no and that's it, without giving any explanation. This is a council that does not give reasons for its decisions. It is a very complex council", García added.
In view of the situation, the developer has lodged an appeal and is still awaiting a response, which should take a month. If the response is not positive, the company intends to file a contentious-administrative appeal to resolve the matter.
The demolition and clearing work expected to finish within the next month or so making space for the construction of a large Mercadona which is scheduled to be completed early next year. The second phase, which is based on the complete renovation of the urbanisation and was planned to start after the summer of 2023, is the one that currently hangs in the balance.
