Ban on going bare-chested in the street amongst 24 civil restrictions in Alicante
Not wearing a shirt in the street, illegal camping and tampering with street furniture in the city of Alicante carries fines of up to 3,000 euros
The Valencian Government controversially banned organised begging and prostitution as part of a revised Civic Coexistence Ordinance, but the document also includes other restrictions for people in Alicante city, including a ban on being shirtless in the street.
Of the 24 restrictions, seven are considered 'minor' with 'offenders' facing fines of up to 750 euros, whilst 'serious' acts carry sanctions of up to 1,500 and 'very serious' offences as much as 3,000 euros.
Prohibited activities/behaviour considered minor or serious and which carry fines of up to 750 euros:
- Being naked or with the torso totally exposed on public roads, except on beaches, promenades, swimming pools or other areas where it is expressly authorised;
- Vehicles parked in open public spaces producing unnecessary noise with alarm or emergency signalling devices, listening to music above the permitted levels in or outside vehicles;
- Carrying out activities that obstruct road traffic, endanger public safety or impede the free movement of pedestrians on pavements, squares, avenues, passages, boulevards and other public spaces;
- Practising acrobatics/stunts with bicycles, skates or skateboards outside the designated areas;
- Playing with balls in public spaces, causing harm to third parties, damaging public property or at inappropriate times;
- Offering services or products, in a persistent or intimidating manner, that have not been requested, such as tarot cards, clairvoyance, massages, tattoos, circus or juggling shows, parking directions, vehicle management and surveillance, windscreen cleaning, or similar, on public roads or in public spaces and/or to people inside private or public vehicles, in exchange for a sum of money or a donation;
- Camping on public roads and in public spaces, except where authorised. Nor is it permitted to sleep during the day or at night in these spaces.
Offences considered 'serious' which carry fines of up to 1,500 euros include:
- Graffiti or writings with any material (ink, paint, organic matter or similar) or instrument (aerosols, markers and similar) on any property or equipment subject to protection;
- Graffiti that damages the environment, for example on public transport, in parks and gardens and on traffic signs;
- Playing games with balls or other objects that may endanger the physical integrity of users of the public space, as well as the integrity of goods, services or facilities, both public and private;
- Using pedestrian steps, disabled access, handrails, benches or any other element of street furniture to perform skateboard tricks;
- Carrying out or inciting acts that violate sexual freedom or acts of obscene exhibition, even when the behaviour does not constitute a criminal offence;
- Street harassment – practices carried out by one or more persons, with sexual connotations, in public or private spaces that cause discomfort;
- Any act of vandalism of street furniture, including any activity or manipulation that makes it dirty, degrades or undermines its aesthetics and normal use;
- Vandalism or modifications of street lighting, kiosks, chains, advertising boards and balustrades;
- Damage to playground facilities, sports areas, public showers, benches, plaques and decorative elements installed in streets and public squares;
- The modification or alteration of bus and bicycle rental stops, bus shelters, traffic signs, traffic lights and other elements connected to traffic and transport services;
- The modification or alteration of vehicles intended for the collective transport of persons;
- Vandalism or any act that results in the deterioration of monuments and public buildings, including bases, pedestals, columns, crosses, commemorative tiles and other identifying landmarks that make up the artistic-monumental heritage of the region;
- Tampering with public litter bins and containers, moving them, tearing them out, setting them on fire, overturning them or emptying their contents on the ground, and anything that damages their aesthetics or hinders their use. Also outlawed is depositing firecrackers, cigarette butts or other lit materials and dangerous materials, instruments or objects inside bins.
And finally, offences considered 'very serious', with penalties between 1,500 and 3,000 euros include:
- Graffiti on monuments, listed or protected buildings or properties;
- Playing games in public spaces and mass and spontaneous sporting competitions that disturb the legitimate rights of neighbours or other users of public spaces;
- Carrying out acts of vandalism that generate situations of risk or danger to the health and physical integrity of people.
