The brother of the UK holidaymaker accused the police in Spain of brutality when he actually died of an overdose
The Union of the Guardia Civil (UniónGC) and the Unified Police Union (SUP) have lodged a complaint with the courts in Spain after officers were allegedly subjected to insults, slander and a hate crime as a result of the death of a British tourist in the Mallorca resort of Magaluf in July.
From the beginning, the police who arrived on the scene maintained that no undue force was used to restrain Tobias. According to officers, bouncers at the nightclub called for back-up when the holidaymaker became aggressive and they believed he had consumed illegal narcotic substances; he was so violent, officials reported, that medical workers had to administer two tranquillisers before he calmed down.
The victim’s brother was vociferous in his complaints against the Spanish authorities, claiming that both bouncers and police “knelt on his head” and beat him “really badly.”
A post-mortem has since confirmed that the Brit’s death was caused by a drug overdose and revealed no significant injuries.
After his death, a website titled ‘Justice for Toby’ and a dedicated Instagram account were launched, garnering more than 415,000 followers. Social media accounts claim that the man was “murdered by the Police” for “not wearing a shirt” and have accused the Guardia Civil of a racially-motivated attack. The website also published a photo of one of the officers involved and appealed for help in identifying him, insisting that he used excessive force against the Briton.
Finally, on Sunday August 21, the name of this agent was revealed.
In a statement, UniónGC and SUP have indicated that the affected officer "is receiving all kinds of humiliations and insults" and that "his image is being distributed by many media, seriously endangering his physical integrity and that of his relatives." A formal complaint has been filed against those responsible for the website and social media accounts for the so-called “smear campaign” against the Guardia Civil.
