EU court ruling reshapes online gambling in Spain 2026
New rules on online gambling for Spanish players. Check out in minutes what the EU Court decision was and how to adapt to these new rules and avoid any issues
What Spanish players must know after the EU court decision

Judgment has been made by the Court of Justice of the EU. This was quite recent, having happened on April 16, 2026. Changes have been made that impact online gamers within Spain looking to play online. Exactly what has changed and what impact will this make on the locals?
Can Spanish players claim compensation for gambling losses?
Yes, Spanish gamblers can ask for this. However, it depends on multiple elements such as:
- Local courts
- Evidence you have
- Limitations
- Case details
Refunds are only available if the site lacks a Spanish license. This applies to operators licensed by the MGA, UKGC or similar foreign bodies. You will need proof of payment to back up your claim. A bank statement works, and so does a screenshot from your eWallet showing the deposit going into that casino.
The same rules cover slots, table games and sports betting alike. Trying out a demo in the UK or Spain doesn't put real money on the line, so there is nothing to claim back in those cases. Slotozilla, for instance, hosts a wide library of such games. Free play sits outside these laws entirely, since most platforms don't even ask you to register an account.
Online gambling in Spain in 2026
Spain is fully capable of creating laws, and online gambling is not an exception. The legality of licensed online casinos within the country is controversial. A licensed online casino cannot be considered a legal online casino within Spain. The Court of Justice of the European Union said that contracts with unlicensed online casinos are void. If something goes wrong while Spanish citizens play in online casinos, they have no legal options.
New law update
It has gained recognition as one that imposes heavy fines. It has been seen issuing fines amounting to more than €142M in the year 2024 alone, and that too is an all-time high record. Fines have been imposed on different online sports betting and gambling sites.
Civil liability is yet another major change that can be seen. The lawyers can defend their clients by arguing they never placed bets. They will also claim there was no valid agreement or proof of any transaction. Casinos licensed by the MGA or other foreign jurisdictions are illegal for Spanish gamblers. The same casinos need a license from the local casino authority to continue serving Spanish bettors.
What counts as an illegal online casino in Spain?
The rule is that an online casino must be licensed in Spain. Here’s a difference between the legal and illegal sites in the country:
| Legal | Illegal |
|---|---|
| Only ES domains | Any other |
| Present in the DGOJ database | MGA or Gibraltar license |
| DGOJ page licensing details | Unavailable on the DGOJ website |
In short, the law made casino licenses issued by the MGA and other European gaming authorities invalid in Spain. Those operators need to apply for the Spain-specific license.
Risks for players using unlicensed gambling platforms
The risk is simple: if you win and the casino won't pay, no one will help. You can find all registered companies on the site run by the Dirección General de Ordenación del Juego. Players should only use operators from this list.
Unregistered online casinos often lack security. They have also been linked to identity theft incidents. All licensed gambling places must join the "Joint Deposit Limits System." This system helps lower financial losses for gamblers.
What Spanish players should do now
The first thing to do is verify the license of the gambling establishment through the official DGOJ website. If a gambling house or betting platform is licensed and its address ends with ".es," you can use it safely. You have all the guarantees mentioned earlier. Save all transaction details right away if you make payments at an unlicensed gambling place. Otherwise, the platform might erase the information.
FAQ
Can I get a refund for my gambling losses?
If you played on the site without the DGOJ's license, you can ask for a refund. This is done in the civil court, and you need proof of the transactions.
Am I allowed to use international gambling sites?
Spanish players should avoid operators not authorised by the DGOJ. DGOJ doesn't cover these operators. In short, you cannot use their help if needed. Sadly, even EU gaming authorities won't help you.
How do I know if a gambling site has a license?
DGOJ's official website holds the answer. On the site, look for the “operator finder.” Only play on the sites that are featured on that list.
Does EU law have the final say over Spanish gambling rules?
In fact, Spain has the final say in this law. This is because they have the right to change the local laws that affect only Spanish residents.
